Guelph company found guilty in excavator fatality

KITCHENER, Ont.

A Guelph, Ont., construction company has been found guilty of not providing a safe work environment.

Lorne Weber, 54, was killed Sept. 14, 2005, when he was run over by a hydraulic shovel excavator. His abdomen and one of his legs were crushed, and he died later in hospital.

Justice of the peace Jeannette DeJong ruled that Cox Construction Ltd. was obligated to ensure the health and safety of workers on the site. She found the company guilty of three charges under the Occupational Health and Safety Act.

Cox will be sentenced this summer.
