VIDEO: How Ontario Construction Lien Act changes will affect construction contractors

The Ontario Construction Lien Act has been amended to require notices from condominium developers and to change the definition of an improvement.

One change to the Lien Act resulted from a court case in which Kennedy Electric Ltd. and other subcontractors registered liens against automotive driveline manufacturer Dana Canada Corp. with respect to factory assembly lines built in 2002.

The amended lien act specifies that building improvements include those which are "essential to the normal or intended use of the land, building, structure or works."

Another change requires builders and developers of condominiums to post notices of intent to register those condos in a construction trade newspaper five to 15 days prior to sending descriptions for approval. Anna Esposito, a lawyer who heads the construction practice at Pallett Valo LLP , spoke about these changes at the Construction Law update conference, produced by MMPI Canada and held at the On the Park Conference Centre in Toronto.
